SAN FRANCISCO – A Pennsylvania-based company is suing a California corporation over allegations of infringement of a patent on a certain medicine cabinet.

Robern Inc. filed a lawsuit on Jan. 8 in the U.S. District Court for the Northern District of California against Shine Bathrooms Inc., citing patent infringement.

The suit claims Shine was importing, offering for sale and selling medicine cabinets in violation of Robern’s patent rights. According to the complaint, Robern owns U.S. Patent No. 8,480,189, which covers a medicine cabinet with an offset hinge. This patent, which Robern applied for in 2010, has led to production of medicine cabinets in the R3 Series Cabinet Collection, which has had commercial success over the last five years, according to the complaint.

The complaint states that Shine Bathrooms was sent a cease and desist letter in May by the plaintiff in regards to its SC----D4PD and SC----D4BD cabinets, which allegedly infringe on the patent in question. The plaintiffs allege that Shine removed the purportedly infringing cabinets from its website but continues to sell them.

Robern is seeking judgment that the defendant infringed on its patent, damages in the amount subject to proof, court costs and attorneys' fees. It is represented by Eileen R. Ridley of Foley & Lardner LLP in San Francisco and by Kadie M. Jelenchick of the same firm in Milwaukee, Wisconsin.
