SAN FRANCISCO – A specialty stores company has moved to confirm an arbitration award to be issued in its favor against a former employee.

The Neiman Marcus Groups LLC motioned to the court to confirm the arbitration award from a June 5 case against Cynthia Walker. Neiman Marcus’ notice of motion and motion to confirm this arbitration award was filed Jan. 5 in the U.S. District Court for the Northern District of California.

According to the June case, Walker, who started working as a sales associate for the Oak Brook, Illinois store on March 29, 2010, was transferred numerous times in her career and court documents stated that she excelled at her position. Walker allegedly applied for an Armani sales associate position at the store after two years of employment. She claimed she was not offered the job after an interview and she believed it was due to her race, sexual orientation and her skin disorder.

The court found in favor of Neiman Marcus. Walker failed to challenge the arbitration award within the Federal Arbitration Act’s three-month deadline and the company wants the court to confirm the award. Neiman Marcus is represented by Patrick C. Mullin and Conor J. Dale of Jackson Lewis in San Francisco.
