Agate Logic accused of using software without purchasing license

SAN JOSE – A software company alleges that a Santa Clara company unlawfully used or accessed its software without obtaining a valid license key.

Synopsys Inc. filed a complaint Feb. 4 in the U.S. District Court for the Northern District of California, San Jose Division against Agate Logic USA Inc., also known as Cloudchip Inc., Agate Logic Beijin Inc. and Does 1-10, citing violations of the Digital Millennium Copyright Act.

According to the complaint, Synopsys Inc. does not sell rights to anyone who wishes to use its electronic design automation software but instead sells licenses. The defendant allegedly used the plaintiff's software without purchasing a valid license key through other means. The plaintiff holds the defendants responsible because they allegedly used plaintiff's software by using counterfeit keys obtained through hacker's websites.

The plaintiff seeks the following: compensation for all damages in the amount of $2,500 for each violation, prejudgment and post-judgment interest, attorney's fees and costs along with any other relief the court deems just and proper.
