SAN FRANCISCO – A San Francisco business is suing an inn, alleging that it unlawfully used a name that sounds and has the same meaning as the plaintiff's.

Inn S.F. Enterprise Inc., doing business as The Inn San Francisco, filed a complaint Feb. 4 in the U.S. District Court for the Northern District of California against Ninth Street Lodging LLC, citing unfair competition, unjust enrichment and trademark infringement.

According to the complaint, the plaintiff alleges that a similar name was used by the defendant for its own purpose, providing the same service as the plaintiff, which then caused confusion among customers. The plaintiff holds Ninth Street Lodging LLC responsible because the defendant allegedly used the name San Francisco Inn, which sounds and looks similar to the plaintiff's.

The plaintiff seeks the following: compensation for all damages, attorney's fees and costs and any other relief this court deems just and proper. It is represented by Christina M. Gagnier of Gagnier Margossian LLP in San Francisco.
