SAN FRANCISCO – A New Jersey man is suing a candy shop alleging that it misrepresents certain Valentine's Day candies as kosher certified.

Avi Weiss filed a class-action lawsuit on Feb. 9 in the U.S. District Court for the Northern District of California against See's Candy Shops Inc., See's Candies Inc., and Does 1 through 5, citing breach of express warranty, fraudulent business acts and practices and false advertising.

According to the complaint, the plaintiff alleges that he purchased the Classic Red Heart Assorted Chocolates from the defendants' Los Angeles shop, which displayed a kosher certification symbol above the chocolates in the shop. However, the suit states, these chocolates are not kosher certified, and the plaintiff claims he would not have purchased them he had known this.

The plaintiff seeks the following: an injunction requiring the defendants to remove the kosher symbol on their products, attorney's fees, costs of the suit and any other relief the court deems just and proper. He is represented by David C. Parisi and Suzanne Havens Beckman of Parisi & Havens LLP in Santa Monica and by Yitzchak H. Lieberman and Grace E. Parasmo of Parasmo Lieberman Law in Los Angeles.
