SACRAMENTO – A Lassen County man currently incarcerated at High Desert State Prison alleges that he was not given medical care in a timely fashion.

Brandon Michael Garcia filed a complaint on Feb. 10 in the U.S. District Court for the Eastern District of California against Dr. Delmar Greenleaf, Dr. Randall Lankford, Dr. Salahuddin Abdur-Rahman, et al., citing cruel and unusual punishment.

According to the complaint, the plaintiff alleges that on Dec. 14, 2014, he was involved in an altercation on the yard and suffered an injury on his left face and eye. X-rays taken the next day showed that he had multiple fractures in his face, the suit states, and was later scheduled for surgery as indicated by notes written on Dec. 26, 2014. However, Garcia alleges he was not taken for surgical evaluation until Feb. 10, 2015, and was then told by a physician that the injury had started to heal and was "too old to fix."

The plaintiff holds the defendants responsible because they allegedly failed to provide medical care and treatment to the plaintiff, which left him with a permanent deformity to his face, migraines and nerve damage.

The plaintiff seeks the following: compensation for all damages, including attorney's fees, and costs of the suit and any other relief this court deems just and proper. He is represented by Julia M. Young of Law Offices of Julia M. Young in Granite Bay.
