SAN FRANCISCO – A San Jose man has filed a class-action complaint against a Pennsylvania business over invasion of privacy claims.
Luis Bravo filed a complaint on behalf of himself and all others similarly situated on Feb. 11 in the U.S. District Court Northern District of California against Advanced Call Center Technologies LLC, alleging that the corporation knowingly violated the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that between Nov. 27, 2015, and Jan. 11, he received multiple calls from the defendant or its agents in an attempt to coerce payment of a debt. Many of the calls made to the plaintiff were made before 8 a.m., the suit states. The plaintiff holds Advanced Call Center Technologies LLC responsible because the defendant allegedly used an automated or prerecorded voice in making calls to plaintiff, which is in violation of the TCPA.
The plaintiff seeks damages of up to $1,500 in treble damages and $500 in statutory damages for every call that allegedly violated the TCPA, any attorneys' fees and costs of the suit and any other relief this court deems just and proper.
