FRESNO – Seasonal workers for a Fresno farm labor contractor allege that the company wrongfully failed to pay all wages owed to them.

Atsiri Cardenas, Raul Pina, Honoria Garcia, Andres Gonzalez, Florentina Pina, Sergio Velasco, Lupe Alvarez and Wilmar Ramirez filed a class-action lawsuit on Feb. 23 in the U.S. District Court Eastern District of Caliornia, Fresno Division against Westside AG Inc. and Does 1-10 inclusive, citing violations of California labor codes.

According to the complaint, the plaintiffs allege that they were employed by the defendant but were not fairly compensated for all hours worked. The plaintiffs allege they reported on time as the defendant specified, but had to wait an hour or more before they could start working and thus those hours were not paid by the defendant. The plaintiffs hold Westside AG Inc., and Does 1-10 responsible because they allegedly refused to pay fair wages to the plaintiffs as well as failed to properly compensate them with hours worked in excess of 40 per week. The suit also states they were not paid in a timely fashion after termination.

The plaintiffs seek the following: full amount of unpaid minimum wages, including interest, legal fees, and any other relief the court deems just and proper. They are represented by Mark Yablonovich, Patrick J. Clifford and Christopher Pantel of Law Offices of Mark Yablonovich in Los Angeles.
