Several trust funds sue company over alleged violation of ERISA

Money

SAN FRANCISCO – Several trust funds are suing a California business over allegations of unpaid contributions.

District Council 16 Northern California Health and Welfare Trust Fund, the Bay Area Painters and Tapers Pension Trust Fund, et al. filed a complaint Feb. 23 in the U.S. District Court for the Northern District of California against Chris Hyland, individually and doing business as Hyland-Tsukamoto Painting & Decorating, citing breach of contract and violation of the Employee and Retirement Income Security Act.

According to the complaint, the plaintiffs allege that they entered into a bargaining agreement with the defendants wherein the employers would contribute to the plaintiffs' ERISA funds. The plaintiffs hold the defendants responsible because the defendants allegedly failed and refused to pay plaintiff from September 2011 to August 2014, based on the audit of the defendants' payroll.

The plaintiffs seek the following: unpaid contributions and interest, legal fees and any other relief the court deems just and proper. They are represented by Michele R. Stafford and Matthew P. Minser of Saltzman & Johnson Law Corp. in San Francisco.
