Class-action suit filed against VIA International Inc. over alleged labor code violations

SAN FRANCISCO – A former manager of network services is suing his ex-employer for allegedly unpaid wages after the company ceased operations in 2015.

Michael J. Marley filed a class-action lawsuit on Feb. 25 in the U.S. District Court for the Northern District of California against VIA International Inc., DSI Entertainment Systems Inc., STEARNS Enterprises Inc. and Does 1-10, citing unfair business practices, violation of the Federal WARN Act and other counts.

According to the complaint, the plaintiff alleges that on Oct. 14, 2015, he and other employees were wrongfully released from their jobs without being provided their final wages. The plaintiff holds the defendants responsible because they allegedly laid him off without providing 60 days advance written notice of their terminations, and also denied him his final wages and benefits.

The plaintiff seeks the following: awarding of unpaid wages and benefits allegedly owed by the defendants, legal fees, and any other relief the court deems just and proper. He is represented by Christina A. Humphrey of Marlin & Saltzman LLP in Agoura Hills and Santosh Narayan of Narayan Law APC in Pasadena.
