Aetna Life Insurance Co. accused of violating of ERISA

SAN FRANCISCO – A Pleasant Hill woman alleges that her insurance company denied her long-term disability benefits.

Kathleen Dolce filed a complaint on March 8 in the U.S. District Court for the Northern District of California against Aetna Life Insurance Co., citing violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she was found to be disabled and applied for a long-term disability plan benefits and received them for five years, but was later denied by the defendant over claims that she was able to work. The suit states that she applied for disability benefits from the Social Security Administration and was approved. The plaintiff holds Aetna Life Insurance Co. responsible because the defendant allegedly denied plaintiff's appeals, claiming it relied on the opinions of consultants as opposed to the doctors treating her.

The plaintiff seeks the following: compensation for all damages, interest, all legal fees and any other relief as the court deems just and proper. She is represented by P. Randall Noah of the Law Offices of P. Randall Noah in Orinda.
