Unum Life Insurance Co. of America sued over allegations of violating ERISA

FRESNO – A Stanislaus County woman alleges that her insurance company wrongfully denied her benefit claims.

Dena C. Mott filed a complaint on March 9 in the U.S. District Court for the Eastern District of California, Fresno Division against Unum Life Insurance Co. of America, citing violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that on July 25, 2014, she became disabled due to multiple medical conditions. Because of this, plaintiff applied for long-term disability benefit claims under the plan which her employer purchased, but was allegedly denied on March 31, 2015. The plaintiff holds Unum Life Insurance Co. of America responsible because the defendant allegedly denied plaintiff's benefit claims despite multiple appeals.

The plaintiff seeks the following: plan benefits, all legal fees and any other relief as the court deems just and proper. She is represented by Nick A. Ortiz of the Ortiz Law Firm in Pensacola, Florida.
