Golden West Envelope Corp. accused of not paying contributions

SAN FRANCISCO – Trustees of a retirement plan allege that an Oakland corporation wrongfully failed to pay contributions to the trust fund on behalf of its employees.

Trustees on behalf of Supplemental Income 401(k) plan filed a complaint on March 9 in the U.S. District Court for the Northern District of California against Golden West Envelope Corp., citing violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that the plan suffered damages in the amount of $12,144, plus interest, due to the defendant's failed payments from the period of May 1, 2014 to present. The plaintiffs hold Golden West Envelope Corp. responsible because the defendant allegedly failed to pay contributions to the trust fund on behalf of approximately 23 of its active employees as per the signed bargaining agreement between the Teamsters District Council Two, Local 388M and the defendant.

The plaintiff seeks the following: compensation for liquidated damages amounting to $1,457.58, $12,144 in unpaid contributions, interest, all legal fees and any other relief as the court deems just proper. They are represented by Catherine E. Arostegui of Beeson, Tayer & Bodine APC in Sacramento.
