Van Nuys man accuses Volkswagen of fraud

LOS ANGELES – A Van Nuys man is suing a car manufacturer alleging he suffered damages as a result of the use of a "defeat device" that was purportedly installed so the vehicles could pass emissions tests.

Richard Nahmias filed a complaint on Feb. 18 in the U.S. District Court for the Central District of California, Western Division against Volkswagen Aktiengesellschaft and Volkswagen Group of America Inc. citing alleged breach of implied warranty, breach of warranty, fraud and other counts.

According to the complaint, the plaintiff alleges that he leased 2010 and 2013 diesel Volkswagen Jettas that had a defeat device installed. The suit states he leased the vehicles based on his beliefs that they were environmentally safe. The plaintiff holds Volkswagen Aktiengesellschaft and Volkswagen Group of America Inc. responsible because the defendants allegedly manufactured vehicles with defeat devices to mask the fact they would not pass emissions standards, despite of environmental laws in place.

The plaintiff seeks the following: restitution, punitive, consequential and incidental damages; attorney's fees; and the cost of suit. He is represented by Stephen G. Recordon of Recordon & Recordon in San Diego.
