SAN FRANCISCO – A San Diego resident is suing several department stores alleging that they knowingly misled customers into thinking that their products were being sold at sale prices.
Todd Benson filed a class-action lawsuit on March 14 in the U.S. District Court for the Northern District of California against Macy's Inc., Macy's West Stores Inc. and Bloomingdale's Inc., citing fraudulent business practices.
According to the complaint, the plaintiff alleges that he purchased items that were labeled as on sale but in fact were being sold at regular prices. The plaintiff holds Macy's Inc., Macy's West Stores Inc. and Bloomingdale's Inc. responsible because the defendants allegedly misled customers into believing that the items they're selling are discounted, when in fact the defendants artificially inflated the regular prices in order for customers to think they're saving money by purchasing the "sale" items.
The plaintiff seeks the following: restitution, enjoining the defendants from engaging in such misconducts in the future, all legal fees and any other relief as the court deems just and proper. He is represented by Rosemary Rivas of Finkelstein Thompson LLP in San Francisco.
