SACRAMENTO – A school district in Calaveras County is suing an artificial turf manufacturer over claims the field turf failed prematurely.
Bret Harte Union High School District filed a complaint on March 16 in the U.S. District Court for the Eastern District of California against Fieldturf USA Inc., Fieldturf Inc. and Fieldturf Tarkett SAS, citing alleged breach of contract, fraud, negligence, negligent misrepresentation and unfair competition.
According to the complaint, the plaintiff alleges that it contracted with the defendants to install an artificial turf field in 2009 at Bret Harte High School for $592,113.48. The suit states the turf had an eight-year warranty. The plaintiff alleges that the field started splitting, thinning and breaking in 2014.
The school district holds the defendants responsible because the defendants allegedly failed to honor their agreement in accordance to their contract and failed to replace the defective field at no cost to the district.
The plaintiff seeks the following: compensation for all damages in the amount of $592,113.48 plus interest and treble damages, all legal fees and any other relief as this court deems just and proper. It is represented by Peter F. Lindborg and Irina J. Mazor of Lindborg & Mazor LLP in Glendale.
