SAN FRANCISCO – A Napa winery has filed a suit against a Massachusetts business alleging that it is illegally using the plaintiff's trademark.
Smith-Anderson Enterprises Inc.
filed a complaint on March 21 in the U.S. District Court for the Northern District of California against
Boston East Tyngsboro Holdings LLC, doing business as Stonehedge Inn & Spa; Boston East India Hotels LLC; Stonehedge Cellars LLC; and Benchmark Wine Group Inc.; citing alleged trademark infringement and unfair competition.
According to the complaint, the plaintiff alleges that it suffered damages to its business and name as a result of its trademarks Stonehedge, Stonehedge Winery and Stonehedge Cellars being utilized by the defendant and potentially creating confusion among the plaintiff's customers. The plaintiff holds the defendants responsible because they allegedly used plaintiff's Stonehedge mark in marketing their products online without authorization.
The plaintiff seeks the following: compensation for all damages, show cause for the defendants why they should not be enjoined, permanent injunction for the agents of the defendant from further marketing products bearing plaintiff's mark, profits derived from selling products that bear the Stonehedge mark, all legal fees and any other relief as this court deems just and proper.
