SACRAMENTO – A woman is suing her insurance company alleging that she is disabled and the company denied her benefits.
filed a complaint on March 22 in the U.S. District Court for the Eastern District of California against
Liberty Life Assurance Co. of Boston and Does 1 to 100, citing violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that she was disabled while the plan was in full effect and submitted a claim for disability benefits in August 2014, and despite performing all the conditions of the plan, she was denied benefits. The plaintiff holds Liberty Life Assurance Co. of Boston and Does 1 to 100 responsible because the defendant allegedly continually failed and refused to provide disability benefits to the plaintiff despite appeals.
The plaintiff seeks the following: compensation for all damages plus interest, all legal fees and any other relief as this court deems just and proper. She is represented by David Allen of David Allen & Associates in Sacramento.
