Man alleges Aetna denied coverage for daughter's treatment
SAN FRANCISCO – A Cook County, Illinois man alleges that his employer's insurance company did not cover medical treatment his daughter needed for a mental health condition.
Mark L. and Elaine L.
filed a complaint on March 22 in the U.S. District Court for the Northern District of California
against Aetna Life Insurance Co. citing violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiffs allege that Elaine L. required residential treatment at a facility for her mental health conditions. The plaintiffs hold Aetna Life Insurance Co. responsible because the defendant allegedly denied plaintiffs' claim for benefits on the basis that Elaine's condition did not meet their criteria. The suit states that the total cost for her treatment is $202,592.
The plaintiffs seek the following: unpaid expenses along with interest, all legal fees and any other relief as the court deems just and proper. They are represented by David M. Lilienstein of DL Law Group in San Francisco and Brian S. King of Brian S. King, PC in Salt Lake City, Utah.
