Woman files suit over alleged denial of disability benefits

Medical malpractice 05

SAN FRANCISCO – A former Roche U.S. employee alleges that she has been denied disability payments by her insurance company.

Lauren Tillner filed a complaint on March 25 in the U.S. District Court for the Northern District of California against Liberty Life Insurance Co. of Boston Inc., US Roche Short-Term Disability Plan and US Roche Long-Term Disability Plan, citing violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she suffered damages and will suffer damages in the future as a result of her benefits being held back by the plan provider. The plaintiff holds Liberty Life Insurance Co. of Boston Inc., US Roche Short-Term Disability Plan and US Roche Long-Term Disability Plan responsible because the defendant allegedly denied plaintiff's application for plan benefits despite the plaintiff performing all her obligations and providing adequate supporting documents to her claim.

The plaintiff seeks the following: trial by jury, all damages, payment for all benefits due and owed by defendant of more than $75,000, all legal fees plus interest, and any other relief as this court deems just. She is represented by Bennett M. Cohen of Law Offices of Bennett M. Cohen in San Francisco.
