SACRAMENTO – A California man is suing a medical company alleging that it knowingly manufactured and distributed defective products that may cause injuries to others.
Ronald Tizenor Jr. filed a complaint on March 30 in the U.S. District Court for the Eastern District of California against
Zimmer Inc., Zimmer Holdings Inc. and Zimmer Orthopaedic Surgical Products Inc., citing breach of implied warranty, breach of express warranty, design defect and negligence.
According to the complaint, the plaintiff alleges that between Oct. 10, 2011 and May 11, 2015, he sustained injuries as a result of a defective knee implant in his right knee. The plaintiff holds Zimmer Inc., Zimmer Holdings Inc. and Zimmer Orthopaedic Surgical Products Inc. responsible because the defendants allegedly manufactured defective medical implants.
The plaintiff seeks a trial by jury, damages according to proof, punitive, statutory and exemplary damages, interest, all legal fees and any other relief as the court deems just. He is represented by Rhett A. McSweeney and David M. Langevin of McSweeney Langevin LLC in Minneapolis and Don K. Ledgard of Capretz & Associates in Newport Beach.
