Anthem employee alleges wrongful denial of benefits

SAN FRANCISCO – A former Anthem employee alleges she was wrongfully denied benefits despite medical evidence stating she can no longer work.

Lauralyn Ploscaru filed a complaint on April 11 in the U.S. District Court for the Northern District of California against Wellpoint Flexible Benefit Plan, Anthem Life Insurance Co., ATH Holding Co. LLC, The Anthem Cos. Inc. and Anthem Insurance Cos. Inc. alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she became disabled as a result of several nervous system conditions during her employment and filed for a long-term disability benefit claims in December 2014, but was denied. The plaintiff holds the defendants responsible because the defendants allegedly relied upon the opinion of an inexperienced physician to deny plaintiff's claim despite having medical records to support it.

The plaintiff seeks order to payment of benefits plus interest, declare plaintiff's rights to receive future disability benefits, declare that the defendant provide retroactive coverage from April 1, 2015, through December 2016, all legal fees and any other relief as the court deems just.
