Nonprofit seeks court's help to determine ownership of Blue Avocado

SAN FRANCISCO – A nonprofit corporation has filed a complaint for declaratory judgment against Santa Cruz individual to determine who owns an online magazine.

American Nonprofits Inc. filed a complaint seeking declaratory judgment on April 11 in the U.S. District Court for the Northern District of California, San Francisco Division against Jan Masaoka to determine the ownership of Blue Avocado magazine.

According to the complaint, the plaintiff alleges Masaoka claims ownership of Blue Avocado despite not being the originator. The suit states it was actually conceptualized by employees of CompassPoint Nonprofit Services, who transferred it to the plaintiff in 2012.

The plaintiff seeks declaration that American Nonprofits owns the Blue Avocado publication, injunctive relief and any other relief as this court deems just. It is represented by Peter Glaessner of Allen, Glaessner, Hazelwood and Werth LLP in San Francisco and Carlton J. Willey of Willey & Bentaleb LLP in San Francisco.
