Photographer accuses publisher of copyright infringement

SAN FRANCISCO – A Napa photographer is suing a New Jersey global publisher over allegations it violated an agreement between the two parties in regards to photographs.

Peter Menzel, doing business as Peter Menzel Photography, filed a complaint on April 13 in the U.S. District Court for the Northern District of California against Pearson Education Inc., citing copyright infringement.

According to the complaint, the plaintiff alleges that between 1994 and 2015, he suffered damages as a result of his work being utilized outside of the agreement of both parties. The plaintiff holds Pearson Education Inc. responsible because the defendant allegedly used false misinterpretations in order to obtain the photographs at a lower cost and printed more copies of his works than authorized.

The plaintiff requests a trial by jury and seeks permanent injunction against the defendant, impoundment of all copies of plaintiff's work used in violation of plaintiff's exclusive copyrights, actual damages and all profits derived from unauthorized use of plaintiff's works, all legal fees and any other relief as the court deems just.
