Laborer alleges QLM Inc. did not pay overtime

SAN FRANCISCO – A laborer for a general construction company alleges he is owed unpaid wages.

Eugenio O. Jimenez filed a complaint on April 20 in the U.S. District Court for the Northern District of California against QLM Inc. and Darrell Dean Quallas Jr. citing violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he was required to work for more than 40 hours per week but was not paid any overtime wages. The plaintiff holds QLM Inc. and Darrell Dean Quallas Jr. responsible because the defendant allegedly misclassified the plaintiff to avoid paying overtime.

The plaintiff seeks compensatory damages for all wages earned but not paid including overtime wages, liquidated damages equal to the unpaid overtime wages, unpaid wages based on misclassification, unpaid compensable wages for off-the-clock work, interest or 10 percent on the unpaid overtime compensation, all legal fees and any other relief as this court deems just.
