Trust funds accuse Hardman Glazing Systems Inc. of breach of bargaining agreement

SAN FRANCISCO – Several union trust funds have filed suit against an employer over allegations of unpaid contributions.

District Council 16 Northern California Health and Welfare Trust Fund and its joint board of trustees; Chris Christophersen and John Maggiore; Northern California Glaziers, Architectural Metal and Glass Workers Pension trust fund and its joint board of trustees; Chris Christophersen and Alfred (Skip) Weltz, et al. filed a complaint on April 22 in the U.S. District Court for the Northern District of California against Hardman Glazing Systems Inc., citing violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that an audit found that between Oct. 1, 2010, and April 30, 2014, the defendant did not pay contributions on behalf of its employees. The plaintiffs hold Hardman Glazing Systems Inc. responsible because the defendant allegedly failed and refused to pay monthly contributions as per their bargaining agreement.

The plaintiffs seek any unpaid contributions, liquidated damages on all late and unpaid contributions plus interest, an order for the defendant to comply with its obligations to the trust fund, all legal fees and any other relief as the court deems just. They are represented by Michele R. Stafford and Matthew P. Minser of Saltzman & Johnson Law Corp. in San Francisco.
