SAN FRANCISCO – A therapist alleges that her insurance firm wrongfully terminated her disability benefits.
Jane Doe filed a complaint on April 27 in the U.S. District Court for the Northern District of California against Metropolitan Life Insurance Co. citing violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that she is disabled according to the terms of the plan and submitted a claim for benefits. She alleges her benefits were paid for a year and suddenly terminated in March 2015. The plaintiff has appealed but was denied several times, the suit states. The plaintiff holds Metropolitan Life Insurance Co. responsible because the defendant allegedly terminated plaintiff's plan benefits despite plaintiff complying with its terms.
The plaintiff seeks pay past benefits owed to her plus interest, declaration that she is entitled to future benefits, all legal fees and any other relief as this court deems just. She is represented by James P. Keenley and Brian H. Kim of Bolt Keenley Kim LLP in Berkeley.
