Man claims Monterey Financial Services Inc. continued to call despite requests to stop

SACRAMENTO – A Folsom man alleges that an Oceanside business robocalled him at an annoying and harassing rate.

Gordon Clark filed a complaint on April 29 in the U.S. District Court for the Eastern District of California against Monterey Financial Services Inc. alleging violation of the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that in November 2015, he received phone calls on his mobile telephone in an attempt to collect a debt he purportedly owed to the defendant. The plaintiff holds Monterey Financial Services Inc. responsible because the defendant allegedly kept on calling plaintiff despite plaintiff's demands to stop.

The plaintiff requests a trial by jury and seeks statutory damages of $500 for each call that violated the TCPA, treble damages, actual damages, statutory damages of $1,000, punitive damages, all legal fees and any other relief as this court deems just. He is represented by Lemberg Law LLC in Wilton, Connecticut and by Trinette G. Kent of Phoenix, Arizona.
