Man alleges Texas companies violated the TCPA

SACRAMENTO – A Sacramento man alleges that two Texas companies contacted him despite being registered on the National Do Not Call list.

Joshua Berghouse filed a complaint on May 3 in the U.S. District Court for the Eastern District of California against GC Services Limited Partnership, Owner Resource Group LLC and Does 1-10, citing violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in April he was contacted on his cellular phone by the defendants using an auto dialer. The plaintiff holds GC services Limited Partnership, Owner Resource Group LLC and Does 1-10 responsible because the defendants allegedly contacted plaintiff despite the fact that his number was registered with the National Do Not Call list.

The plaintiff seeks $500 for each violation or $1,500 per violation in statutory damages that was knowingly committed, to enjoin defendants from engaging in further violations, actual damages, all legal fees and any other relief as this court deems just. He is represented by Nathaniel Clark and Seaton Tsai in Los Angeles.
