Toyota owner files suit over use of allegedly defective airbags

SAN FRANCISCO – A Toyota Corolla owner has filed suit against the auto manufacturer and others over the use of Takata airbags.

Roseana Weartherwax filed a complaint on May 3 in the U.S. District Court for the Northern District of California against Takata Corp., TK Holdings Inc., Toyota Motor Co. LTD, Toyota R&D Co. LTD, Toyota Motorco. Inc., and Toyota Manufacturing Inc. citing negligence, failure to warn, breach of implied warranty and other counts.

According to the complaint, the plaintiff alleges that her 2005 Corolla has depreciated in value because the Takata airbags in it can explode and cause injury. The plaintiff holds the defendants responsible because the defendants allegedly knew about the defects but failed to disclose this information to their customers until 2013.

The plaintiff requests a trial by jury and seeks actual and compensatory damages, exemplary and punitive damages, all legal fees and any other relief as this court deems just. She is represented by Lingel H. Winters of Law Offices of Lingel H. Winters PC in San Francisco.
