Ultratech Inc. alleges Mass. company breached contract

SAN FRANCISCO – A San Jose corporation is suing a Massachusetts business over claims it violated a software agreement between the two companies.

Ultratech Inc. filed a complaint on May 3 in the U.S. District Court for the Northern District of California against Analog Devices Inc. citing copyright infringement and breach of contract.

According to the complaint, the plaintiff alleges that between March 2013 and May 2015, it suffered damages to its business as a result of its steppers still being utilized and maintained by the defendant. The plaintiff holds Analong Device responsible because the defendant allegedly retained the service of another maintenance company to service and maintain the steppers they acquired from plaintiff and transferred the software to another party, which violated its master software license agreement with the plaintiff.

The plaintiff requests a trial by jury and seeks actual damages, injunction against the defendant, statutory damages, compensatory damages plus interest, all legal fees and any other relief as the court deems just. It is represented by L. Scott Oliver of K&L Gates LLP in Palo Alto.
