SAN FRANCISCO – A Windsor consumer has filed a class-action lawsuit against a Vernon company over its flavored coffees.
Taylor Ely filed a complaint on behalf of all others similarly situated and the general public on May 18 in the U.S. District Court for the Northern District of California against F. Gavinia & Sons Inc. citing violation of the California Consumers Legal Remedies Act., unfair competition, false advertising and other counts.
According to the complaint, the plaintiff alleges that the defendant's Don Francisco flavored coffee products do not state whether the flavors are artificial or natural as required by California and Food and Drug Administration regulations. The plaintiff alleges that the defendant's labeling misleads consumers into thinking they are buying a naturally flavored gourmet product.
The plaintiff requests a trial by jury and seeks restitution and disgorgement of defendant's revenues from falsely labelled products, damages, all legal fees and any other relief as this court deems just.
