Consumer alleges doughnuts do not contain maple as advertised

SAN FRANCISCO – A Shasta Lake consumer has filed a class-action lawsuit a food manufacturer alleging its maple-glazed mini doughnuts are falsely advertised.

Elizabeth J. VanCleave filed a complaint on behalf of a class of similarly situated individuals on May 23 in the U.S. District Court for the Northern District of California against Hostess Brands LLC and Does one through five, citing fraudulent inducement, violation of the False Advertising Act and other counts.

According to the complaint, the plaintiff alleges that in April, she purchased a box of doughnuts which she believe were glazed with maple, but upon inspection the product did not contain any maple syrup or sugar. The plaintiff holds Hostess Brands LLC and Does one through five responsible because the defendants allegedly made false claims about the contents of their product.

The plaintiff requests a trial by jury and seeks actual damages, injunction against the defendant, interest, disgorgement of profits received through their unlawful acts, all legal fees and any other relief as this court deems just.
