Man files suit seeking benefits from Lincoln National Life

SAN FRANCISCO – A Wymac Capital employee alleges that an insurance company wrongfully denied his application for long-term disability benefits.

Darrell Wiley filed a complaint on May 25 in the U.S. District Court for the Northern District of California against The Lincoln National Life Insurance Co. alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he became disabled on June 30, 2013, and applied for disability benefits in December 2014, but was denied by the defendant. The plaintiff holds The Lincoln National Life Insurance Co. responsible because the defendant allegedly denied plaintiff initial application for disability benefits and denied several appeals requested by plaintiff for his LTD benefits.

The plaintiff seeks all benefits due to plaintiff plus interest at the rate of 10 percent per annum, attorney's fees of $220,000, and any other relief as the court deems just. He is represented by Laurence F. Padway of Law Offices of Laurence F. Padway in Alameda.
