SAN FRANCISCO – Individuals have filed a class-action lawsuit against a Vacaville debt collector alleging it repeatedly called them to threaten and harass into collecting the purported debts.
Sandra McMillion, Jessica Adekoya and Ignacio Perez filed a complaint on behalf of all others similarly situated on June 17 in the U.S. District Court for the Northern District of California against Rash Curtis & Associates alleging violation of the Telephone Consumers Protection Act.
According to the complaint, the plaintiffs allege that between 2015 and 2016, they were called by the defendant on their cellular phones several times despite their requests to stop calling them. The plaintiffs hold Rash Curtis & Associates responsible because the defendant allegedly used robocalls to contact the plaintiffs.
The plaintiffs request a trial by jury and seek injunctive relief, $1,500 as treble damage for each call, $500 as statutory damages for each call, all other damages, all legal fees and any other relief as the court deems just.
