Prestige Autotech Corp. files patent suit over wheels

SACRAMENTO – A Chino corporation alleges a Stockton business is selling wheels that are copies of a patented design.

Prestige Autotech Corp. filed a complaint on June 20 in the U.S. District Court for the Eastern District of California against Tire & Wheel Master Inc., doing business as Tire & Wheel Master Wholesale Distributor; Tire & Wheel Master LLC, doing business as Tire & Wheel Master Wholesale Distributor; and USA Wheel & Tire Outlet Inc. alleging that they distributed wheels that are poor copies of the '542 and '174 patents.

According to the complaint, the plaintiff alleges that it suffered damages to its business and reputation as a result of its products and designs being imitated and distributed by the defendants without its authority. The plaintiff holds Tire & Wheel Master Inc., doing business as Tire & Wheel Master Wholesale Distributor; Tire & Wheel Master LLC, doing business as Tire & Wheel Master Wholesale Distributor; and USA Wheel & Tire Outlet Inc. responsible because the defendants allegedly sell wheels that are imitation of the '542 patent and the '174 patent currently owned by plaintiff.

The plaintiff requests a trial by jury and seeks damages to compensate plaintiff plus interest, increased damages plus interest, permanently enjoin the defendant, all legal fees and any other relief as the court deems just.
