Former Fantastic Sams owners seek declaratory relief

SAN JOSE – Former salon franchise owners allege that the franchisors are requesting payments despite the fact the franchise is no longer in business.

Capelli Enterprises Inc., Nameer Jalel and Aseel Issa filed a complaint on June 17 in the U.S. District Court for the Northern District of California, San Jose Division seeking declaratory relief.

According to the complaint, the plaintiffs owned a Fantastic Sams salon franchise through the defendants that they closed in April. The suit states that the defendants still seek to collect franchise fees despite the fact that the plaintiffs closed and has threatened litigation.

The plaintiffs seek temporary restraining order, permanent injunction, all legal fees and any other relief as the court deems just. They are represented by Marc A. Eisenhart, James L. Dawson and Nicholas G. Emanuel of Gates Eisenhart Dawson in San Jose.
