Man claims San Francisco companies called him without permission

SAN FRANCISCO – An Orange County man alleges companies called him six times without his consent to sell him solar panels.

Sean Bozarth filed a complaint on behalf of all others similarly situated on June 24 in the U.S. District Court for the Northern District of California against Sunrun Inc., Clean Energy Experts LLC, doing business as Solar America, and Does 1 through 10 alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in June, he was called by the defendants using autodialing equipment. The plaintiff holds Sunrun Inc., Clean Energy Experts LLC and Does 1 through 10 responsible because the defendants allegedly called plaintiff without his consent and despite his number being listed with the National Do Not Call Registry.

The plaintiff requests a trial by jury and seeks injunctive relief, $1,500 for each violation as treble damages, $500 as statutory damages for each violation, all legal fees and any other relief as the court deems just. He is represented by Reuben D. Nathan of Nathan & Associates APC in Newport Beach and Ross Cornell of Ross Cornell APC in Long Beach.
