Amy's Kitchen Inc. seeks to recover funds

SAN FRANCISCO – A plan administrator is seeking recovery of medical expenses it paid for a participant's auto accident.

Amy's Kitchen Inc., as plan administrator of the Amy's Kitchen Employee Benefit Health Plan, filed a complaint on June 29 in the U.S. District Court for the Northern District of California against Brett Campbell and Carter & Fulton PS seeking declaratory relief.

According to the complaint, the plaintiff alleges it covered medical expenses for Campbell as a result of an auto accident in 2014 in the amount of $241,621.50. The suit states Campbell filed a claim for injuries and damages against the responsible parties and that the plaintiff is now seeking reimbursement for the medical expenses as per the benefit plan.

The plaintiff seeks $241,621.50 plus interest, to enjoin the defendants from transferring or disposing of any settlement funds, order to turn over the proceeds of the settlement up to $241,621.50 plus interest, all legal fees and any other relief as the court deems just.
