Class action filed against county of Modoc alleging FLSA violations

SACRAMENTO – A woman has filed suit against a California county alleging underpayment of overtime hours worked.

Julie Winkle filed a complaint on behalf of all similarly situated individuals on June 30 in the U.S. District Court for the Eastern District of California against the county of Modoc alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that she worked for more than 40 hours for the defendant but was not paid any overtime wages. The plaintiff holds the county of Modoc responsible because the defendant allegedly failed to pay plaintiff at a rate of time-and-one-half for all hours she worked in excess of 40 hours per workweek.

The plaintiff seeks unpaid overtime wages plus interest, liquidated damages, injunctive relief, all legal fees, and any other relief as the court deems just. She is represented by David E. Mastagni, Isaac S. Stevens and Ace T. Tate of Mastagni Holstedt APC in Sacramento.
