Suit filed against HGTV operators by artist over alleged song use

SAN FRANCISCO – A recording artist known for "It's a Marshmallow World" and for playing Danny Glover's wife in the movie "Lethal Weapon" alleges a cable network used one of her songs without permission in a commercial.

Darlene Love filed a complaint on July 7 in the U.S. District Court for the Northern District of California against Scripps Networks Inc. alleging copyright infringement.

According to the complaint, the plaintiff alleges that she suffered damages as a result of her voice being used without her consent by the defendant. The plaintiff holds Scripps Networks Inc. responsible because the defendant allegedly used plaintiff's recording of the song "Christmas (Baby Please Come Home)" on one of its advertisements for HGTV without first contacting plaintiff for her consent.

The plaintiff requests a trial by jury and seeks damages of more than $75,000, exemplary damages, all legal fees and any other relief as the court deems just. She is represented by Steven Ames Brown of Entertainment Law 83363 in San Francisco.
