Contego Investigative Services Inc. alleged to have not paid overtime wages

SACRAMENTO – An investigator has filed a suit against his current employer over allegations of unpaid overtime.

Sean Miner filed a complaint on July 8 in the U.S. District Court for the Eastern District of California against Contego Investigative Services Inc. alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that in 2014 to the present, he worked for more than 40 hours without being paid any overtime wages by the defendant. The plaintiff holds Contego Investigative Services Inc. responsible because the defendant allegedly misclassified plaintiff as an exempt employee in order to avoid paying him any overtime compensation at a rate of time-and-one-half.

The plaintiff requests a trial by jury and seeks back pay for all hours worked in excess of 40 hours per week, liquidated damages equal to the unpaid wages, interest, punitive damages, restitution, all other damages and statutory penalties, all legal fees and any other relief as the court deems just. He is represented by David E. Mastagni and Isaac S. Stevens of Mastagni Holstedt APC in Sacramento.
