Linsy Painting & Decorating accused of not paying contributions

SAN FRANCISCO – Trust funds have filed suit alleging an employer has not paid them contributions as agreed upon in a bargaining agreement.

District Council 16 Northern California Health and Welfare Trust Fund and its joint board of trustees; Bay Area Painters and Tapers Pension Trust Fund and its joint board of trustees, et al. filed a complaint on July 11 in the U.S. District Court for the Northern District of California against Norman Hiawatha Linsy, individually and doing business as Linsy Painting & Decorating, alleging breach of bargaining agreement.

According to the complaint, the plaintiffs allege that they suffered damages as the result of unpaid contributions by the defendant from March 23, 2012, to June 30, 2014. The plaintiffs holds Norman Hiawatha Linsy, individually and doing business as Linsy Painting & Decorating, responsible because the defendant allegedly failed to pay his monthly contributions on behalf of his employees to plaintiff.

The plaintiffs seek all unpaid contributions, liquidated damages, interest, all legal and audit fees, and any other relief as the court deems just. They are represented by Michele R. Stafford and Matthew P. Minser of Saltzman & Johnson Law Corp. in San Francisco.
