Beebe Diversified accused of breaching bargaining agreement

Contract 08

SAN FRANCISCO – Several trust funds have filed suit against a Sacramento business alleging they are owed for unpaid contributions.

Board of trustees of the Cement Masons Health and Welfare Trust Fund for Northern California; board of trustees of the Cement Masons Vacation - Holiday Trust Fund for Northern California; board of trustees of the Cement Masons Pension Trust Fund for Northern California; and board of trustees of the Cement Masons Training Trust Fund for Northern California filed a complaint on July 12 in the U.S. District Court for the Northern District of California against Beebe Diversified LP alleging breach of collective bargaining agreement.

According to the complaint, the plaintiffs allege that they suffered damages as the result of unpaid contributions by the defendant from November to December 2015, January and March to June. The plaintiffs hold Beebe Diversified LP responsible because the defendant allegedly failed to pay monthly contributions to the trust fund on behalf of their employees.

The plaintiffs seek $293,749.99, plus interest and liquidated damages, all legal fees and any other relief as the court deems just. They are represented by Ronald L. Richman, Susan J. Olson and Heather J. Zacharia of Bullivant Houser Bailey PC in San Francisco.
