Consumer claims Hot Topic sent unwanted texts

LOS ANGELES – A consumer has filed a class-action suit against a retail store chain over allegations it sent text messages without consumers' consent.

Diana Soukhaphonh filed a complaint on behalf of all others similarly situated on July 12 in the U.S. District Court for the Central District of California against Hot Topic Inc. alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in November 2015, she received unwanted text messages on her cellular telephone from the defendant. The plaintiff holds Hot Topic Inc. responsible because the defendant allegedly advertises its business by sending text messages to consumers without their consent.

The plaintiff requests a trial by jury and seeks injunctive relief, $500 in statutory damages for each violation, $1,500 as treble damages for each violation, all legal fees and any other relief as the court deems just.
