Copyright 06

LOS ANGELES – The owner of graphic artworks used in apparel fabrics alleges a San Diego company used a similar fabric design without its permission.

Unicolors Inc. filed a complaint on July 13 in the U.S. District Court for the Central District of California against Charlotte Russe Inc. and Does 1-10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business as a result of its proprietary design being reproduced without its consent by the defendants. The plaintiff holds Charlotte Russe Inc. and Does 1-10 responsible because the defendants allegedly manufactured and distributed fabrics that bear a similar design to plaintiff's fabric.

The plaintiff requests a trial by jury and seeks to enjoin the defendant, award plaintiff all profits from infringing its design, statutory damages, all legal fees, interest and any other relief as the court deems just. It is represented by C. Yong Jeong of Jeong & Likens LC in Los Angeles.
