LOS ANGELES – A San Bernardino County consumer has filed a class-action lawsuit against a debt collector alleging telephone harassment.

Gabriela Briley filed a complaint on behalf of all others similarly situated on July 13 in the U.S. District Court for the Central District of California against National Credit Systems Inc. alleging violation of the Telephone Consumer Protection Act and the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that beginning in January, she was called several times on her cellular telephone by the defendant despite her requests to stop calling her. The plaintiff holds National Credit Systems Inc. responsible because the defendant allegedly contacted plaintiff through her cellular telephone using an automatic dialing system in an attempt to collect an alleged debt.

The plaintiff requests a trial by jury and seeks $500 in statutory damages, $1,500 in treble damages, actual damages, all legal fees and any other relief as the court deems just.
