Frick Paper Co. alleges company used marks without permission to promote business

LOS ANGELES – An Orange County paper manufacturer alleges that an Indian company used its trademark without authority to promote its business.

Frick Paper Co., doing business as Paper Mart, filed a complaint on July 13 in the U.S. District Court for the Central District of California, Southern Division against Tulip 3P Media PVT LTD alleging trademark infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business as a result of its trademark being used without its consent by the defendant. The plaintiff holds Tulip 3P Media PVT LTD responsible because the defendant allegedly used plaintiff's trademark in its bimonthly e-magazine, which the plaintiff alleges confuses consumers into thinking the two parties are affiliated with each other.

The plaintiff requests a trial by jury and seeks permanent injunction against the defendant; damages; treble damages, restitution, disgorgement, compensatory, consequential, incidental, nominal and/ or special damages; interest; all legal fees; and any other relief as the court deems just.
