Cree Inc. alleges counterfeit goods are being sold online

LOS ANGELES – A maker of light-emitting diode products alleges that counterfeit versions of its goods are being sold on eBay.

Cree Inc. filed a complaint on July 14 in the U.S. District Court for the Central District of California against Flyt E-Commerce Services Inc.; Vincent Yun Zou, also known as Yue Zou; Roy Jian, also known as Rui Jian; Five Star Store Inc.; Xin Zou; Hottime International Corp.; Zhubao Wang; Hao Zhou, also known as Mark Zhou; Ronshin Inc.; Jiajun Wu; Yunqin Jiang, also known as Janice Jiang; and Does 1-10 alleging trademark infringement, false designation of origin and other counts.

According to the complaint, the plaintiff alleges that it suffered damages to its business as the result of its products being infringed and sold without its consent by the defendants. The plaintiff holds the defendants responsible because the defendants allegedly advertised and distributed counterfeit Cree products using eBay.com.

The plaintiff requests a trial by jury and seeks award plaintiff profits and damages, $2,000,000 per counterfeit mark per type of goods, actual damages, statutory damages, restitution, injunctive relief against the defendant, disgorgement of profits, destruction of infringing articles, treble damages, exemplary damages, all legal fees and any other relief as the court deems just.
