Man files claim seeking reinstatement of disability benefits

LOS ANGELES – A man alleges he was wrongfully terminated from receiving benefits from a long-term disability plan.

James Fendick filed a complaint on July 14 in the U.S. District Court for the Central District of California against Life Insurance Co. of North America alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in December 2013, he was denied of any further disability benefits by the defendant despite still being disabled according to the terms of the plan. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly upheld its denial of plaintiff's disability benefits despite plaintiff still being disabled.

The plaintiff seeks award benefits due to plaintiff plus interest, order that he is entitled to future disability benefits, all legal fees and any other relief as the court deems just. He is represented by Frank N. Darras, Lissa A. Martinez, Susan B. Grabarsky and Phillip S. Bather of Darras Law in Ontario.
